Cake Terms and Conditions

All sales made by Swissybuns are subject to the following terms and conditions. Nothing contained within these terms and conditions affects your statutory rights as a consumer

Placing an Order

After discussion on your ideas and a design has been agreed the following process will apply. An Order form will be drawn up and sent via email. When the customer has checked the order form and confirmed the cake details are correct a booking can be made. Placing a booking is agreement from the customer to accept the terms and conditions of business as stated in this document and found on Swissybuns website.

Timescales

Usually, 3 months’ notice is required for wedding cakes and 2 weeks for celebration cakes is sufficient.

Price

The price for the order shall be stated on your order form. The customer is supplied with a copy of the terms and conditions of business at this point.

While we take every measure possible to check orders it is also the responsibility of the customer to make sure the details on the order form are correct.

We will only go ahead with your order on receipt of an email confirming your order is accurate.  While we will do everything we can to rectify the situation when an error is made i.e. if the wrong date/recipient names are given, the responsibility ultimately lies with the customer to check the details are correct at time of ordering.

Payments may be made by:
  • Cash
  • BAC’s payment
  • If paying by cheque, payment must be made for the full amount at the time of ordering.
Deposits

All deposits become due once your order is confirmed, a deposit of 50% is payable to secure your date, which is then non-transferable and non-refundable. All orders are deemed to have been accepted by Swissybuns only when the deposit has been paid.

i.e: Your order and date in our diary are secured upon receipt of the above deposit amount and no guarantees will be given on availability of your date until the deposit has been paid in full.

Final Payments

The Final Balance due for wedding cakes is payable 28 days before the wedding and for celebration cakes 10 days before the event.

If delivery is required payment must be made in full within the time frames given.

The cake will not be available without payment. If paying final balance on collection/ delivery has been agreed, it must be in cash.

Alterations to Orders

Your cake is very important to us. Please take the time to check your copy of the order form carefully and let us know within three days if changes are needed. It is your responsibility to advise Swissybuns of any alterations to the original order.

Swissybuns reserves the right to increase a quoted fee in the event that the Customer requests a variation to the work agreed. Changes to the design of the cake after confirmation of booking will result in additional cost and therefore a change of price.  Whilst every effort will be made to assist Customers, please note that late changes cannot always be guaranteed.

Non- Payments

In the event of non –payment, the order will not be completed or released, until payment is made in full.

Subsequent completion of the order will be subject to availability and cannot be guaranteed.

Swissybuns accepts no responsibility for any loss (howsoever caused) or non – delivery under these circumstances.

The customer will be responsible for the payment of any additional charges which have been incurred as a result of payment failure.

Delivery

Your order can be delivered, for a fee. All delivery times are subject to availability. If you have a specific delivery date and require delivery before a given time, please specify this when placing your order. We will do our best to accommodate your requirements. It is the Customer’s responsibility to ensure Swissybuns has been given the correct delivery information, and that someone is available to receive your cake. A signature will be required for the receipt of the order upon delivery.

If the recipient is not in, the order will be returned to Swissybuns who will contact you to arrange an alternative delivery time for which an additional fee will be payable by the customer. Swissybuns accepts no responsibility for any loss or consequential loss incurred by the Customer as a result, e.g. a wedding without a wedding cake.

When a cake is to be delivered it remains the property of the company while in transit. Where any damage occurs then it is the sole responsibility of Swissybuns to make good any damage. If this is not possible, for whatever reason, then a full refund will be given.

Setting Up

Should you require your cake to be delivered, Swissybuns will deliver and set up your cake as agreed and will want to ensure it is displayed at its best. It is your responsibility to ensure that you have provided us with the set-up details and arrangements made with the venue for the location and display of your cake. Swissybuns cannot be held responsible for the location of the cake at the venue. Please ensure, therefore, that the cake location is level, stable and strong enough to hold the cake.

Please also remember that chocolate-covered cakes can melt in warm conditions such as inside a marquee on a hot summer’s day, or when set up in direct sunlight. Once the cake has been collected or delivered, set up and signed for, Swissybuns is unable to accept liability for any interference with or damage to the cake thereafter.

If the cake is to be delivered and set up by Swissybuns, a signature will be required from your venue management confirming the cake has been received and set up in good condition. A photograph of the cake will be taken prior to departure by us to verify that the cake has been set up and left in good condition.

Collection

Your order may be collected at a pre-arranged time. A signature is required upon collection confirming that you have received your order in good condition and as specified.

We accept no responsibility for loss or damage once the cake has been collected. As you will appreciate, once the cake leaves us/the studio then responsibility then refers to the customer and we/Swissybuns are no longer liable for any damage in transit. Please be aware that a flat surface is required to retain the stability of the cake and should be secured where possible to remove the risk of movement in transit.

Non-Edible Decorations

During the design process, the customer will be informed of any non-edible decoration that will be used to construct the cake. A written copy of this information will be given.  The customer must relay this information to the venue/hosts.

Copyright

The design copyright is the property of Swissybuns. The customer does not have any claim on the design.  Swissybuns reserves the right to use images of any design for promotional purposes following the event.

Cake Component Parts

From time to time some materials for our celebration cakes and wedding cakes may become obsolete or no longer available from our suppliers, for example, pre – manufactured items or ribbon colours. This is totally out of our control, though we will endeavour to re-design a cake to reflect as closely as possible the original design using replacement products. In all cases, we will try to contact you to advise you of any such changes. However, Swissybuns, reserves the right to replace these with components of equal or better quality without consultation.

Cancellations/Refunds

As your wedding cake and/or special order booking is reserved solely for you and certain components for your cake/s may be ordered months in advance, the following conditions are implemented when an order is cancelled:

  • 3 months from delivery date – 50% of the total cost will be payable
  • 3 months and under from delivery date – 100% of the total cost will be payable
Other cake order cancellations:

Full payment is required if cancellation is within 14 days of delivery date, prior to this a refund of any monies paid, less deposit, will be paid.

All cancellations must be made by telephone, in the first instance and confirmed in writing or by email.The cake will only be cancelled when the client is in receipt of a Cancellation Acceptance from Swissybuns, which will either be a printed letter or an email from Swissybuns.

Allergies

Please be aware that whilst your chosen cake may not be made with nuts or a nut product, egg, dairy wheat or gluten, it will be prepared in a kitchen where nut products, eggs, dairy, wheat and gluten are heavily used. Whilst every effort is made to separate raw materials Swissybuns must state that raw materials used in your cake may not be free from nuts, eggs dairy, wheat or gluten.

Best before Dates

When preparing some cakes, especially larger ones, the cakes need to be in prep for two sometimes three days before the event. While we do everything to ensure that the cake is as fresh as possible for the event the best before dates are usually within two days of the event.

To assist in prolonging the shelf life the cakes are best placed in a sealed container (this will damage a sugarpaste finish) in the fridge. We do not accept liability for consumption from two days following the event.

Customer Satisfactions Guarantee

Should you be unhappy with the cake we will do everything we can to rectify the matter before the event. If you are still unsatisfied then we will refund the price of cake in return for the product.

If there is a design problem the cake is to be photographed and e-mailed within 48 hours of the cake being collected or delivered. Situations where the cake is eaten, and therefore not returned, vouchers may be offered.

If you have a complaint about the taste of the cake then a sample is to be provided within 24 hours.

Conditions

Swissybuns does not accept liability and shall not be liable for non-completion of any event or for any delays arising as a result of:

Strikes, riots or lockouts affecting any trade with which Swissybuns is concerned, exceptionally adverse weather conditions.

Loss, damage or cancellation due to fires, floods of any other cause beyond its reasonable control.

The liability of Swissybuns in respect of all claims arising under any contract should be limited to the amounts of the price or charges payable to Swissybuns under such contracts.

Swissybuns shall not be liable under any circumstances for any indirect cause of consequential loss or damage whatsoever to property belonging to Swissybuns or Hired, if accidentally, willfully or negligently damaged or stolen at any event, the replacement cost is payable by the Client within 7 days from the date of the event.

Accidental damage at the event should be covered by the Clients own insurance and no claim will be accepted by Swissybuns or the Hire Company.

 

 The London Cake Academy Course Attendance Terms and Conditions

Notice: You have/are entering into an agreement with The London Cake Academy.

Terms: Due to such a high demand for places, a part payment non-refundable deposit is required in order to secure your booking. Once you have secured your place online the remaining balance is then due in cash on the day of your class.

The London Cake Academy reserves the right to cancel or change a course. In these circumstances, The London Cake Academy will do what they can to offer a substitute date or course. Where this is not convenient, The London Cake Academy will provide a full refund.

In the unlikely event that the advertised tutor is unable to teach the class The London Cake Academy reserves the right to substitute with an alternative tutor who is of a similar standard.

Please be aware that it is possible that the class may run over the expected finish time.

The skills learnt during your time with us are intended for you to use within your own business and under no circumstances should the class be replicated and taught to your own students.

No video or photography is permitted without express permission from each individual tutor.

Refunds or Transferring your Place: The London Cake Academy is unable to offer any refunds should you decide to cancel or are unable to attend the course. However, should you be unable to attend you may transfer your place to another student through your own marketing of the place, subject to The London Cake Academy’s approval. There is a £20 transfer fee to cover administrative costs. Only in exceptional circumstance will you be able to transfer to another course, which is solely at The London Cake Academy’s discretion and the £20 administrative fee applies.

Exceptional circumstances do NOT include:

o  Inability to partake in  a course due to travel problems

o  Inability to partake in a course due to changes in personal circumstances

o  Seeking to cancel within 4 weeks of the course date (full fee will apply)

o  Inability to attain the required VISA to enter the UK

o  Travel or accommodation expenses will not be compensated for should a course be cancelled or re-arranged for an alternative date.

 

Overseas Visa: Overseas students are advised that if necessary The London Cake Academy will offer a letter confirming the booking once the course has been booked and paid in full. For legal reasons, The London Cake Academy cannot offer a letter inviting an overseas national to take up a course place that has not yet been booked. Take out Insurance: If you wish to protect yourself then it would be worth consulting Cancelsure or visit their website. They will advise on protecting the course fee and can offer advice on where to protect your travel and accommodation costs too. Non-UK residents are advised to contact their local insurance adviser.
